1. General provisions

1.1 These Terms of Purchase and Sale of Goods (hereinafter referred to as the Terms) govern the use of the auksinvest.lt website and determine the procedure for shopping at auksinvest.lt. auksinvest.lt reserves the right to change these Terms at its own discretion at any time. All changes to the Terms come into effect from the moment the Terms are changed. By using the website, you confirm that you agree to the Terms and any changes to them. These Terms and Conditions, after the buyer agrees to them (i.e. upon familiarization with the Terms and Conditions of Purchase and Sale of Goods and ticking the box next to the statement “I have familiarized myself with and agree to the Terms and Conditions of Purchase and Sale of Goods”), are a binding legal document for the parties, which determine the rights and obligations of the buyer and seller, conditions of purchase and payment for goods, order of delivery and return of goods, responsibility of the parties and other provisions related to the purchase and sale of goods in the auksinvest.lt online store.

1.3. You have the right to buy in our online store:

1.3.1. Legal entities;

1.3.2. able-bodied natural persons, that is, persons who have reached the age of majority, whose capacity is not limited according to the procedure established by law;

1.3.3. minors between the ages of 14 and 18, but only with the consent of their parents or guardians, except in cases where they dispose of their income independently;

1.3.4. all 1.3.1-1.3.3. authorized representatives of the specified persons.

1.4. By agreeing to the Terms, the buyer confirms that, based on the Terms 1.3. point, he has the right to buy goods in the auksinvest.lt online store.

2. Trade territory

2.1. In the online store auksinvest.lt, sales are carried out in the territory of the European Union. With the consent of the seller, the goods can be sold to the buyer outside the territory of the European Union.

3. Procedure for purchasing goods

3.1. The buyer can buy goods by registering in the online store auksinvest.lt, entering his registration name and password, however, registration is not mandatory. The buyer, in the specified information fields, must specify the data necessary for the proper fulfillment of the order.

3.2. By agreeing to these Terms and Conditions, the buyer confirms that he agrees that the personal data provided by him will be processed for the purposes of selling goods in the auksinvest.lt online store, in accordance with the procedure established by legal acts.

3.3. The seller does not disclose or distribute the buyer’s information. 4.2. 5. Buyer’s rights and obligations

5.2. 5.3. The buyer can exercise the right provided for in Clause 5.2 of the Terms and Conditions only if the product has not been damaged, damaged or worn, the product is in its original packaging and the buyer has all the original documents.

5.9. 6. Seller’s rights and obligations

6.1. The seller undertakes to enable the buyer to use the services provided by the auksinvest.lt online store under the conditions set out in these Terms and Conditions and the online store.

6.2. If the buyer attempts to harm the stability and security of the online store or violates his obligations, the seller has the right to immediately and without warning limit or suspend his access to the online store or, in certain cases, cancel the buyer’s registration.

6.3. In case of important reasons, the seller can temporarily or completely stop the operation of the online store without prior notice to the buyer.

6.4. The seller has the right to cancel the order without notifying the buyer in advance, if the buyer does not provide all the data necessary to fulfill the order and it is not possible to contact the buyer on the phone or e-mail indicated by him, as well as if the full payment has not been made. In this case, the term of delivery of the goods starts counting from the moment of providing all the information and/or payment. The seller has the right to cancel the order without prior notice to the buyer if the seller fails to contact the buyer within five (5) business days.

6.5. The seller undertakes to respect the buyer’s right to the security of his data and to use the buyer’s data only in accordance with these Terms and applicable legal acts.

6.6. The seller undertakes to deliver the goods ordered by the buyer to the address specified by the buyer in accordance with the procedure set out in these Terms.

6.7. The seller, unable to deliver the ordered product to the buyer due to important circumstances, undertakes to offer an analogous product or a product that is as similar as possible. If the buyer refuses to accept an analogous or similar product, the seller undertakes to return the money paid to the buyer within seven (7) working days, if payment has been made.

7.3. The seller reserves the right not to fulfill the order if incomplete order or payment information is provided or incomplete payment is made.

7.4. By approving the Terms and Conditions, the buyer agrees that the documents for the purchase of the goods will be presented to him at the time of delivery or collection of the goods. After placing an order, the buyer can see and print the information related to prepayment in the created personal account (if the buyer chooses to create one). The buyer’s personal account indicates the selected goods, their quantity, discounts, the final price of the goods, delivery and other fees and other information necessary for accounting.

7.5. The buyer and the seller agree that after the buyer submits an order for the product and the seller confirms it, the price of the product may change, taking into account objective indicators that affect the price of the product, such as an increase in the cost price of the product, a technical error in the information systems, additional costs related to the sale of the product to the buyer (LR CK Article 6.313, d. 7). In such case, if the buyer does not agree to purchase the product at a new price, any of the parties, having notified the other party, has the right to terminate the contract of purchase and sale of the product. The parties agree that losses related to the termination of the sales contract in accordance with the procedure provided for in this clause shall not be compensated.

8. Delivery of goods

8.1. The goods are delivered to the buyer by mail, courier, messenger or other authorized representative of the seller. The goods are delivered in the territory of the European Union. With the consent of the seller, the goods can be delivered outside the European Union. In cases provided by the seller, goods can be delivered free of charge.

8.2. The buyer undertakes to indicate the exact place of delivery of the goods.

8.3. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods have been delivered to the specified address, the buyer has no right to make claims against the seller regarding the delivery of the goods to the wrong entity. Accordingly, upon delivery of the goods to the address specified by the buyer, the goods will be deemed to have been properly delivered to the buyer.

8.4. The seller provides the goods to the buyer in accordance with the terms specified in the product descriptions and auksinvest.lt. These terms are preliminary and do not apply in cases where the seller does not have the required items in stock. At the same time, the buyer agrees that the delivery of the goods may be delayed due to unforeseen circumstances beyond the seller’s control.

8.5. In all cases, the seller is released from responsibility for the violation of the terms of delivery of the goods, if the goods are not delivered to the buyer or are delivered late due to the buyer’s fault or due to circumstances beyond the seller’s control.

8.6. During the delivery of the goods to the buyer, the buyer must check the condition of the shipment and the goods(s) together with the seller or his authorized representative and sign the delivery-acceptance document. After the buyer signs the shipment transfer-acceptance document, it is considered that the shipment is delivered in a suitable condition, there are no damage to the goods, the basis of which cannot be attributed to a factory defect, and there are no inconsistencies in the package of the product(s) (such as can be determined during the external inspection of the goods). Upon noticing that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the buyer must note this in the shipment transfer-acceptance document and , in the presence of the seller or his representative, to draw up a free-form act of violation/nonconformities of the shipment and/or product(s). If the buyer does not perform these actions, the seller is exempted from responsibility towards the buyer for damage to the goods, if these discrepancies can be determined during the external inspection of the goods and, accordingly, the goods are considered to be delivered in a suitable condition and of good quality.

8.7. If the buyer wishes, the buyer can pick up the goods at the address specified by the seller. After the buyer collects the goods at the address specified by the seller, it will be considered that the goods have been properly delivered to the buyer and meet the requirements agreed by the parties. Such collection of goods from the seller is subject to the conditions provided for in Clause 8 of the Terms and Conditions related to the delivery, inspection and collection of goods.

9. Product quality guarantee

9.1. The characteristics of each product sold by auksinvest.lt are generally indicated in the product description attached to each product. The actual characteristics of the product manufactured and sold may slightly differ from the characteristics of the product indicated on the website auksinvest.lt.

9.2. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the buyer.

9.3. The parameters of certified gemstones specified on the website (e.g. diamond color, weight or clarity) may in certain cases differ from the parameters given to the gem or product by the Lithuanian Assay Chamber, because the Lithuanian Assay Chamber, when evaluating the certified products, gives its assessment a 20% error probability.

9.4. In the event that the seller does not provide or does not indicate the term of the product quality guarantee, the guarantee provided by the relevant legal acts shall apply.

10. Return of goods

10.1. The buyer has the right to return the goods to the seller within 30 days from the day of delivery. The return guarantee does not apply to goods manufactured according to the Buyer’s individual order (i.e. goods not from the range offered for sale by the Seller on the auksinvest.lt website).

10.2. When returning goods to the buyer, it is necessary to comply with the following conditions:

10.2.1. the returned item must be in its original, neat packaging;

10.2.2. the product must be undamaged;

10.2.3. the product must be unused, without losing its commercial appearance (undamaged and untorn labels, untorn product label and certificate established by the Lithuanian Chamber of Probation, international certificates provided, if any, etc.);

10.2.4. the returned item must be of the same configuration as the buyer received;

10.2.5. when returning the product, it is necessary to present the document of its purchase, all certificates that were presented with the product;

10.2.6. when returning the product, it is necessary to indicate the return code provided by the seller.

10.3. The seller has the right not to accept the goods returned by the buyer if the buyer does not follow the procedure for returning the goods established in this article or if the returned goods do not meet the established return requirements. Worn, modified, altered or damaged items are not accepted for return. Goods will also not be accepted for return if the buyer does not have a return code, the package is damaged, parts of the package are missing or the accessories transferred with the product are missing. In the event that the original quality certificate is missing, the product label is damaged or torn off, the seller reserves the right to demand payment of the fee required for re-certification of the product or not to accept such product for return.

10.4. When returning goods of suitable quality, the buyer pays the costs of returning the goods. Returned goods must be sent by registered post and fully insured during transport for an amount not less than the purchase value of the goods.

11. Liability

15.2. Products with diamonds are sold in the territory of the European Union (except the Republic of Lithuania) and have international diamond quality certificates or Lithuanian Assay Chamber quality certificates.

15.3.
